Backyard smokers are treated as open-flame cooking under Virginia's Fire Prevention Code. They may not be used on combustible balconies or within 10 feet of combustible construction, and charcoal/wood smokers should be attended and kept clear of siding and eaves.
Outdoor smokers in Prince William County fall under the same Statewide Fire Prevention Code rule as grills (SFPC 308.1.4): charcoal, wood, or other open-flame cooking devices may not be operated on combustible balconies or within 10 feet of combustible construction. On apartment balconies only electric or very small (one pound or less) LP-gas devices are allowed unless the building is sprinklered. In a detached-home backyard, a smoker used solely for cooking is permitted β it counts as noncommercial outdoor food preparation under DEQ open-burning rules β provided it is attended, uses clean fuel, and is kept a safe distance from the house and combustibles.
The Fire Marshal's Office may order removal of a smoker used in a prohibited location and cite SFPC 308.1.4 violations; unsafe use can be abated as a fire hazard.
