New Castle County regulates outdoor lighting under UDC Article 40 lighting standards, requiring full-cutoff fixtures for new commercial and multifamily development. Residential dark-sky rules are limited; light trespass onto neighbors is addressed through nuisance provisions. Full International Dark-Sky Association certification is not adopted countywide. Wilmington has separate municipal lighting rules.
Outdoor lighting in New Castle County is regulated primarily through UDC Article 40 lighting standards applicable to new commercial, institutional, and multifamily developments. The UDC requires full-cutoff (fully shielded) fixtures that direct light downward and limit glare, with foot-candle maximums at property lines, typically 0.5 fc at residential boundaries and 1.0 to 2.0 fc at commercial boundaries. Parking lot lighting has specific pole height limits, commonly 25 to 35 feet, and coverage patterns designed to avoid spillover. Wall packs must be shielded or fully cutoff. Color temperature is increasingly regulated with preference for warm LEDs (3000K or below) to reduce blue light pollution affecting wildlife and sleep. The UDC does not impose dark-sky requirements on existing residential properties, but severe light trespass from residential security lights can be addressed under the nuisance provisions of NCC Code Chapter 9. Full adoption of International Dark-Sky Association (IDA) standards is not in place countywide, though some subdivisions and conservation-focused HOAs in the Brandywine Hundred and Hockessin areas voluntarily adopt dark-sky practices. The Delaware Division of Fish and Wildlife and Delaware Audubon have promoted dark-sky friendly lighting in coastal and migratory corridor areas including the Delaware Bay shore. State parks (Brandywine Creek, White Clay Creek) maintain minimal lighting. Wilmington, Newark, and Middletown have their own municipal lighting codes.
Non-compliant commercial lighting: correction notice with 30 to 60 days to retrofit, fines $100 to $500 per fixture. Residential light trespass as nuisance: civil abatement order under NCC Code Chapter 9, potential injunction. Parking lot spillover onto residential properties: site plan amendment required and potential permit revocation.
