City-specific rules exist: Burlington has its own abandoned vehicles rules that differ from Racine County's county-level regulations. If you live in Burlington, check the city-specific page instead.

No person shall leave unattended any motor vehicle, trailer, semitrailer or mobile home on any public highway or public or private property for such time and under such circumstances as to cause the vehicle to reasonably appear to have been abandoned. Any such vehicle in the same place for forty-eight (48) hours or more, or parked on a public roadway in such a manner as to constitute a traffic hazard, or parked in a posted no-parking zone shall be deemed abandoned and a public nuisance. A motor vehicle shall not be considered abandoned when it is out of ordinary public view or when designated as not abandoned by the sheriff or his duly authorized representative.

Full Breakdown

Under Sec. 12-80 of the Racine County Code, no one may leave a motor vehicle, trailer, semitrailer or mobile home unattended so long, or under such circumstances, that it appears abandoned. Any vehicle left in the same place 48 hours or more, parked so as to create a traffic hazard, or parked in a posted no-parking zone is deemed abandoned and a public nuisance. Sheriff's deputies who find an abandoned vehicle on a public highway or public property must have it towed to impoundment (§ 12-81). Vehicles over 19 model years old go straight to disposal under § 12-84; others are held for reclamation.

Violations & Fines

Violating Sec. 12-80 lets the sheriff tow and impound the vehicle; owners face towing/storage fees and risk losing the vehicle if unclaimed after the notice period.

Frequently Asked Questions

Under Sec. 12-80, 48 hours in the same spot, or blocking traffic, or sitting in a no-parking zone, makes a vehicle abandoned and a public nuisance.
Can I get my towed vehicle back?
Yes: the sheriff must mail notice, and owners get at least 10 days to reclaim the vehicle and pay towing/storage before it's sold or junked (§§ 12-82–12-84).
