Summary

Kent County Zoning Code § 205-27 bars storing, parking or abandoning inoperable, wrecked or unregistered motor vehicles on any lot. Owners get a narrow exception for up to two exempt vehicles at a time, covering ones recently purchased and awaiting inspection, listed for sale, actively being repaired within 90 days, or held pending an insurance or estate settlement.

These county ordinances apply to unincorporated areas of Kent County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

B. Land may not be used partially or principally as a junkyard or a solid waste disposal facility. C. Land may not be used for the parking, storage, collection, accumulation or abandonment of: (1) Any inoperable, wrecked, partially dismantled or destroyed motor vehicles; (2) Any motor vehicle that is subject to the registration requirements of the Delaware Vehicle Law that does not display current registration plates and a validation tag issued for the current year by the Division of Motor Vehicles; or (3) Any motor vehicle that poses a threat to the health, safety and general welfare of the occupants or other persons.

Full Breakdown

Section 205-27 treats unregulated vehicle storage as a junkyard problem and regulates it accordingly. Subsection B forbids using any land partially or principally as a junkyard or solid waste disposal facility. Subsection C goes further and bars parking, storing, collecting, accumulating or abandoning any inoperable, wrecked, partially dismantled or destroyed motor vehicle; any vehicle subject to Delaware's registration law that lacks current plates and a current-year validation tag from the Division of Motor Vehicles; or any vehicle that poses a threat to health, safety or general welfare.

Subsection D gives property owners a limited safety valve: no more than two motor vehicles per lot can be exempted from Subsection C if the owner can show the vehicle is recently purchased and pending inspection for no more than 60 consecutive days, actively advertised for sale for no more than 60 days, actively being repaired toward a registrable condition within 90 days (or a written extension the Department grants for good cause), or held pending settlement of an insurance, estate or similar claim. Subsection E adds a placement rule for any vehicle covered by the section: it cannot encroach into the front or side yard setback lines, so even an exempt vehicle has to stay out of the setback area.

The section exempts sanitary landfills operating under state and County law, licensed automotive dismantling and recycling facilities, vehicles stored as accessory to a lawful auto sales or service business, and any unregistered vehicle kept entirely inside a roofed, fully enclosed structure.

Violations & Fines

Keeping an inoperable, unregistered or abandoned vehicle beyond the two-vehicle, time-limited exemptions in § 205-27.D is a Chapter 205 violation enforced under § 205-426.C: a misdemeanor or civil offense with a fine of $100 to $1,000, up to 10 days in jail, or both, and every additional day of noncompliance treated as a separate offense. The County may also tow the vehicle and bill the owner for removal costs under the remedial-action authority in § 90-10, and can pursue an injunction under § 205-426.B to force compliance.

Frequently Asked Questions

Can I keep a broken-down car in my yard in Kent County?
Only under narrow conditions. Section 205-27.C bans storing inoperable, wrecked or unregistered vehicles outdoors, but § 205-27.D exempts up to two vehicles per lot if they are recently purchased and pending inspection, for sale, being actively repaired within 90 days, or held for an insurance or estate settlement.
How many unregistered vehicles can I have on my property?
No more than two per lot qualify for the exemption in § 205-27.D, and each must fit one of the listed categories, such as pending inspection or active repair within a 90-day window. Any additional vehicle, or one outside those categories, violates § 205-27.C regardless of how many are on the lot.
Can I store a junk car inside my garage instead?
Yes. Section 205-27.A(4) exempts storage or maintenance of unregistered vehicles or other junk kept within a roofed structure entirely enclosed on all sides, so a fully enclosed garage avoids the outdoor storage restrictions in Subsection C.
