Full Breakdown

LDC Section 34-3107 requires duplex and two-family attached units to be built with one driveway per unit, at least 20 feet wide and 20 feet long, constructed of concrete, asphalt or concrete pavers and complying with Lee County AC 11-12. You must keep it safe and pothole free for the life of the dwelling, and long-term or permanent use of the driveway for anything other than vehicle parking and driving is prohibited. Cutting a new driveway into a County-maintained road is work in the right-of-way, which Section 10-296(n) says needs a permit from the County Department of Transportation first.

Violations & Fines

Code Enforcement handles driveway violations. Under LDC Section 2-427, the Hearing Examiner may impose $25.00 to $1,000.00 per day for a first violation and $50.00 to $5,000.00 per day for a repeat violation.
