Summary

New residential and non-residential projects in unincorporated Merced County that add 10 or more parking spaces must install electric and alternative-fuel vehicle spaces on a sliding scale set by Zoning Code Section 18.38.150. Preferential EV spaces must be marked and placed near building entrances without displacing ADA or carpool spots.

These county ordinances apply to unincorporated areas of Merced County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A. Electric and alternative fuel vehicle parking shall be provided for all new residential projects and non-residential projects, additions, or alterations that add 10 or more vehicular parking spaces, in compliance with the requirements in Table 3-11 (Electric and Alternative Fuel Vehicle Parking Space Requirements), the standards specified in the California Building Code, and the California Green Code. B. Preferential parking for alternative fuel vehicles is encouraged and each space shall be provided with a sign/marking that identifies the parking space as designated for use by alternative fuel vehicles only. Preferential parking spaces shall be located as close as possible to the primary entrance without conflicting with parking provided to meet the Americans with Disability Act (ADA) requirements or preferential parking provided for carpool/vanpools.

Full Breakdown

150(A) requires electric and alternative fuel vehicle parking for all new residential and non-residential projects, additions, or alterations that add 10 or more vehicular parking spaces, following Table 3-11 alongside the California Building Code and California Green Code. Table 3-11's schedule requires no dedicated spaces for developments providing 1 to 9 total spaces, 1 space at the 10-to-25-space tier, climbing to 3 spaces at 26-50, 6 at 51-75, 8 at 76-100, 11 at 101-150, 16 at 151-200, and at least 8 percent of total spaces for any development over 200 spaces.

Subsection (B) makes preferential parking for alternative fuel vehicles encouraged rather than mandatory but requires any such space to carry a sign or pavement marking restricting it to alternative fuel vehicles, positioned as close as possible to the primary entrance without conflicting with ADA-required spaces or carpool/vanpool preferential parking. Subsection (C) allows sites that already have vehicle recharging stations to dual-designate those spaces as both charging stations and preferential EV parking. Subsection (D) requires EV and alternative-fuel parking areas to carry exterior lighting for security and so drivers can operate the charging equipment, shielded and directed downward to limit glare on neighboring properties, and subsection (E) bars any recharging station from blocking or impeding pedestrian access along a sidewalk.

Subsection (G) lets the Director grant a case-by-case exception from the installation requirement where electrical supply is insufficient or where meeting the standard would raise utility-side infrastructure costs by more than $400 per dwelling unit.

Violations & Fines

EV parking space requirements are conditions of building and site plan permits enforced by the Merced County Planning Director; a project that fails to install the Table 3-11 minimum cannot obtain final occupancy approval. Ongoing noncompliance, such as blocking a designated EV space or recharging station access, is enforceable as a general Zoning Code infraction under Section 1.28.030, with fines from $100 to $500 depending on repeat offenses.

Frequently Asked Questions

Does my new Merced County business have to install EV charging spaces?
Only if the project adds 10 or more vehicular parking spaces. Section 18.38.150(A) then requires the number of EV and alternative-fuel spaces set out in Table 3-11, which scales from 1 space at the 10-25 space tier up to 8 percent of total spaces for lots over 200 spaces.
Can I mark an EV parking space as reserved in Merced County?
Yes, and the code encourages it. Section 18.38.150(B) requires any preferential alternative-fuel space to be signed or marked and located near the entrance, as long as it does not conflict with required ADA or carpool/vanpool spaces.
Can Merced County waive the EV charging requirement for my project?
Yes, under Section 18.38.150(G) the Director may grant a case-by-case exception if electrical supply is insufficient or if meeting the standard would raise utility-side infrastructure costs by more than $400 per dwelling unit.
