The City of Denton has no local ordinance mandating electric vehicle charging stations in new construction as of 2025. However, Texas Occupations Code Chapter 2157 (effective September 2021) prohibits property owners associations from adopting or enforcing restrictions that prevent a homeowner from installing an EV charging station in a parking space the owner is entitled to use. The HOA may require the owner to carry liability insurance and install at the owners expense but cannot ban the charger. Denton Municipal Electric (DME), the city-owned electric utility, offers a residential time-of-use rate plan that incentivizes off-peak EV charging. The city has installed public Level 2 charging stations at several municipal facilities and the downtown parking garages. New commercial developments may voluntarily include EV-ready parking under the Denton Development Code site plan process. The Denton Sustainability Plan encourages EV adoption but does not impose building code mandates for charging infrastructure.
