Every commercial, manufacturing or institutional building in unincorporated Whatcom County that generates delivery traffic must provide a dedicated off-street loading space under WCC § 20.80.515, sized at least 14 feet wide, 60 feet long and 15 feet of vertical clearance. Required space count scales with floor area and use, and a loading space can never double as required parking.

A loading space shall have minimum dimensions of not less than 14 feet in width, 60 feet in length, exclusive of driveways, aisles, and other circulation areas, and a height of clearance of not less than 15 feet. One off-street loading space shall be provided and maintained on the same lot for every separate occupancy requiring delivery of goods and having a gross floor area of at least 5,000 square feet in the case of manufacturing, warehouse or terminal buildings, and 10,000 square feet for commercial, hotel, institutional and public buildings. Required off-street loading spaces are not to be included as off-street parking space in computation of required off-street parking space.

Violations & Fines

Operating without the required loading space, or loading from a public right-of-way, is a zoning violation enforced under WCC Chapter 20.94: a written notice of violation and penalty of up to $1,000 per day the violation continues, with a stop-work order and minimum $1,000-per-day penalty possible if work continues in defiance of that order. The county can also revoke the underlying building or use permit under § 20.94.070, and a property owner has 20 days to seek remission or may appeal to the hearing examiner under § 20.94.060.
