The City of Buena Park regulates yard and garage sales through its zoning standards (Development Code, Section 19.448.070, in the Special Requirements for Certain Uses). In any RS (residential single-family) zone, on any one lot in residential use, a yard sale may be conducted on not more than two consecutive days within any six-month period, and sales may be conducted only between 8:00 a.m. and sunset. The Planning FAQ states this plainly: 'You can hold one (1) yard sale two (2) consecutive days within any 6-month period,' and that 'Yard sales may begin at 8:00 AM and must end at sunset.' Items displayed, offered or sold must be only household items that have been in regular use or storage for six months or more on the same premises, which prevents the sale from operating as an ongoing retail business. Temporary outdoor displays are otherwise allowed only as part of a yard sale authorized under this section or a special-events sale. Operating beyond these limits, or selling merchandise brought in to sell, can be treated as an unpermitted business use.
Holding sales more often than once per six-month period, running longer than two consecutive days, selling before 8:00 a.m. or after sunset, or selling goods not in household use/storage for six months can be cited as a zoning violation handled by Code Enforcement. Repeat or commercial-scale activity may be treated as an unpermitted business and subject to abatement.
