Buena Park does not exempt vacant or undeveloped parcels from its property maintenance rules. Owners must keep land free of weeds, dirt, litter, rubbish and debris that are visible from the street or that create a fire hazard. Neglected vacant lots can be declared public nuisances and abated by the city under its nuisance abatement chapter.
The City of Buena Park's Property Maintenance chapter (Buena Park Municipal Code Chapter 8.36) makes it unlawful for any responsible person to allow property to accumulate weeds, dirt, litter, rubbish or debris visible from the street, sidewalk or public right-of-way to an extent that constitutes visual blight, and this duty applies to vacant and undeveloped parcels as well as occupied ones. The code defines 'weeds' to include dry, dead or dying grasses and vegetation more than three inches in height, including cut vegetation that has not been mulched, plus dry grass, brush, tree litter and other flammable materials that endanger public safety by creating a fire hazard, which is a common concern on neglected lots. Conditions involving refuse, waste, illegal storage and overgrown vegetation are among those identified in Chapter 15.28 (Section 15.28.020) as public nuisances subject to the city's abatement procedures. The city notes that its weed and rubbish provisions continue to apply even where conditions are not visible to public view. Property owners report overgrown or debris-covered lots to the Code Enforcement Division at (714) 562-3642, and the Neighborhood Improvement Task Force proactively inspects problem areas.
An owner who lets a vacant lot accumulate weeds over three inches, rubbish, debris or fire-hazard vegetation may receive a code enforcement notice. Where conditions qualify under Section 15.28.020, the Director can declare a public nuisance, issue a notice and order of abatement, and, if uncorrected, have the city abate the condition and recover its costs from the owner. Owners may appeal to the Planning Commission.
