City Code Sec. 26-2(d) limits outdoor storage to no more than two refuse and recycling containers, kept behind the front plane of the house, on a paved surface, and screened from streets and neighbors. Containers must stay closed at all times and be kept reasonably clean. Garbage cans that are not flytight are a nuisance (Sec. 14-32).
Maple Grove regulates where solid waste containers may be stored under City Code Sec. 26-2, 'Refuse storage and disposal,' subsection (d) 'Placement of containers,' as amended by Ordinance No. 22-03 (adopted February 7, 2022). No more than two refuse and recycling containers may be stored in the open, and they must be in a side or rear yard behind the front plane of the primary structure, directly adjacent to the primary structure or detached garage, on a paved or finished surface. Any additional containers or overflow refuse must be stored within a garage or screened from view from public rights-of-way and all neighboring properties using permanent landscaping or fencing. Containers kept outside must remain completely closed at all times and be placed so as not to permit entry or harborage for animals, insects or vermin, and so as not to be tipped over. Containers must be maintained in a reasonably clean condition at all times. Containers may not be moved to the curb for collection sooner than the day before scheduled collection and must not remain out for more than 24 hours afterward. Separately, City Code Sec. 14-32(2) declares 'garbage cans which are not flytight' a public nuisance.
Improper storage violates Chapter 26. A garbage can that is not flytight is a nuisance under Sec. 14-32, enforceable as a misdemeanor with possible abatement and special assessment under the nuisance provisions.
