Under Montgomery County Code Chapter 26, vacant lots must be maintained to the same standards as improved properties. Grass, weeds, and vegetation may not exceed 12 inches in height. Lots must be free of accumulated trash, debris, standing water, and conditions that harbor rodents or insects. Fencing or barriers must be maintained in good repair. Owners of vacant properties must register with the county if the property has been vacant for more than 30 consecutive days. The DHCA inspects vacant lots upon complaint and during proactive sweeps in areas with high vacancy rates. After a notice of violation, owners typically have 14 days to bring the lot into compliance. If the owner fails to act, the county may hire contractors to mow, clear debris, or secure the property and place a lien on the property for the costs incurred plus an administrative fee.
Fines up to $500 per day per violation. County abatement costs plus administrative fees billed to owner. Liens may be placed on the property. Vacant property registration failure carries additional penalties.
