Summary

On Lake County's interstates, arterials and collector roads, plus the first 440 feet of local roads that intersect them, it's illegal to linger in a median except while actively crossing, and illegal to hand anything to, or take anything from, a vehicle occupant while that vehicle sits in a travel lane.

These county ordinances apply to unincorporated areas of Lake County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(b)It is unlawful for any person to stop, stand, or otherwise occupy or remain in a median on any designated roadway when that person is not in the process of lawfully crossing the road in accordance with applicable traffic and safety laws. Stopping, standing, or otherwise occupying a median through two (2) consecutive opportunities to cross in accordance with applicable traffic and safety laws is prima facie evidence of a violation of this subsection.(c)It is unlawful for any person to engage in any physical interaction between a pedestrian and an occupant of a motor vehicle, including, but not limited to, the transfer of any product or material, while the motor vehicle is not legally parked and is located on the traveled portion of a designated roadway.

Full Breakdown

Sec. 3-80 defines 'designated roadways' as the interstate system, plus arterial and collector roads or rights-of-way classified under the Lake County Comprehensive Plan, including those stretches that run through a municipality and the first 440 feet of any local road intersecting one. The rule reaches the travel lanes and medians of those roads plus four feet beyond the shoulder or curb. Sec. 3-81(b) makes it unlawful to stop, stand, or otherwise occupy a median on a designated roadway unless a person is actively and lawfully crossing; stopping or lingering through two consecutive chances to cross under the traffic signal is treated as prima facie evidence of a violation.

Sec. 3-81(c) separately bars any physical exchange between a pedestrian and a vehicle occupant, including handing over money, food, or any other product or material, while the vehicle is not legally parked and sits on the travelled portion of a designated roadway. Sec. 3-82 carves out law enforcement, fire and rescue, and other government workers or contractors doing their jobs; utility, survey, construction, inspection, maintenance or repair crews; people rendering emergency aid; anyone entering or exiting a bus or transit vehicle; and permitted special events on roads closed to traffic.

The county adopted this ordinance in 2022 as a traffic-safety measure targeting the median standing and window-to-window exchanges commonly associated with panhandling and roadside vending, rather than as a direct ban on asking for money.

Violations & Fines

A violation draws a citation of up to $500 under F.S. Sec. 125.69(1) and Sec. 1-6 of the county code, with each act treated as a separate offense; two consecutive missed opportunities to cross while standing in a median is enough by itself to establish a violation. Issuing a citation does not stop the county from also seeking an injunction or issuing a trespass warning where authorized.

Frequently Asked Questions

Can someone stand in a median asking drivers for donations in Lake County?
Not on a designated roadway, meaning interstates, arterials or collector roads. Sec. 3-81(b) bars occupying a median there unless the person is actively crossing, and standing through two consecutive crossing opportunities is treated as evidence of a violation.
Is it illegal to hand water to a driver stuck in traffic during a heat wave?
It could be, under Sec. 3-81(c)'s ban on pedestrian/vehicle-occupant exchanges on a travel lane, unless it falls under the Sec. 3-82 exemption for a person rendering aid during an emergency.
What's the fine for violating the median or roadway exchange rules?
Up to $500 per citation under Sec. 3-83, with each occurrence counted as a separate offense; the county can also pursue an injunction or a trespass warning in addition to the citation.
Does this ordinance apply to a residential side street?
No. It only applies to 'designated roadways,' meaning interstates, arterials and collectors under the county's comprehensive plan classification, plus the first 440 feet of a local road where it intersects one of those roads.
