Full Breakdown

Baltimore County Code Section 13-7-131 defines an unruly social gathering as a party, event, or assemblage of four or more people at a residence or other private property where alcohol is furnished to or possessed by an underage person, or where conduct causes a substantial disturbance, including excessive noise under Section 17-3-103, excessive traffic for the zoning district, drug use, obstructed streets, public drunkenness, fights, vandalism, public urination, or littering. Section 13-7-132 makes it unlawful for a property owner or any 'responsible person,' defined broadly to include anyone who organizes, supervises, or accepts responsibility for the event even without being present, to conduct, cause, aid, allow, permit, or condone the gathering.

Family gatherings supervised by an adult relative and legally protected religious activities are excluded, as are gatherings involving domestic violence or sexual assault allegations. Under Section 13-7-133, police issue a warning to the property owner for a first offense and a citation for the second and later offenses. Section 13-7-135 gives the property owner a defense if they neither authorized nor knew of the gathering in advance and took action to regain possession of a leased unit.

Violations & Fines

Civil penalties escalate under Section 13-7-134: a first violation brings responsible persons a $500 penalty plus 20 hours of community service and only a warning to the owner; a second violation raises it to $1,000 and 32 hours of service for responsible persons plus a $500 fine for the owner; a third or later violation carries $1,000 and 48 hours of service, with the owner facing a $1,000 fine and possible suspension or revocation of a rental license.

Frequently Asked Questions

How many people make a gathering 'unruly' in Baltimore County?
Four or more people at a residence or other private property qualifies under Section 13-7-131 if the gathering involves underage drinking or conduct causing a substantial disturbance, such as excessive noise, traffic, drug use, fights, vandalism, public urination, or littering. A quiet family gathering supervised by an adult relative is specifically excluded.
Can I be cited even if I wasn't home during the party?
Yes. Section 13-7-131 defines a 'responsible person' to include anyone with a right of possession in the property, and that person does not need to be physically present at the gathering to be cited and fined under Section 13-7-134.
Can a landlord lose a rental license over a tenant's party?
Yes, on the third or later violation within 24 months. Section 13-7-134(a)(3)(ii) subjects the property owner to a $1,000 civil penalty and potential suspension or revocation of the rental license, though Section 13-7-135 offers a defense if the owner did not know of or authorize the gathering and acted to regain possession.
