Santa Cruz County bans smoking outdoors at every unincorporated county park, beach, recreation area and trail, plus outdoor dining patios, under Chapter 7.88 of the county code. § 7.88.070. Prohibition of smoking in outdoor public places. Smoking is prohibited in the following specifically delineated unenclosed areas:
(A) All parks, beaches, outdoor recreation areas, and recreational trails.
(B) Outdoor dining areas.
(C) Within a reasonable distance from any doorway, window, opening, crack, or vent into an enclosed area in which smoking is prohibited.
(D) Within a reasonable distance from any unenclosed areas in which smoking is prohibited under this section, except while the person smoking is actively passing on the way to another destination and provided smoke does not enter any unenclosed area in which smoking is prohibited.

Violations & Fines
Smoking in a prohibited outdoor or indoor area under Chapter 7.88 is an infraction under § 7.88.130. A first violation carries a fine up to $100, a second violation within one year up to $200, and each additional violation within that year up to $500. Property owners, managers or operators who fail to post required signage or otherwise allow violations on premises they control are separately liable as infractions, and the County Health Officer or any person may seek a court injunction to force compliance.
