Sec. 12:602(a) bars smoking and vaping in all enclosed areas of a public place, and Sec. 12:602(b) does the same for workplaces, but subsection (c) reaches outdoors: smoking is unlawful 'whether or not in an enclosed area' within 25 feet of the entrance or exit of any building or facility occupied or operated by the city-parish, in any outdoor service line while the public is being served, and on playgrounds and in parks outright, with no distance qualifier at all.
'Public place' is defined broadly at Sec. 12:600 to include property owned, occupied, or operated by the city-parish, restaurants, retail stores, sports arenas, and theaters, among others, but private residences and personal vehicles are carved out unless used for child care or health-care transport. Enforcement runs through Sec. 1: any law enforcement officer may issue a citation and summons to Baton Rouge City Court, and a business owner or manager must direct a violator to stop and, if they refuse, ask them to leave. The rule covers city-parish territory outside Baker, Zachary, Central, and St.
George, which run their own codes. Sec. 12:601 clarifies the chapter does not override any stricter smoking rule an owner or operator wants to impose on their own property.
Violations & Fines
An individual caught smoking in a restricted outdoor spot, whether the 25-foot entrance buffer, a service line, or a playground or park, faces a fine of up to $50 per violation under Sec. 12:601.2(d). An owner, manager, or employer who fails to stop the smoking and ask the person to leave is separately liable under Sec. 12:601.2(c): up to $500 for a first offense, $700 for a second within 12 months, and $900 for a third, with occupancy-permit revocation after five violations in a year.
