Section 8.22.030 of the County Code bans smoking of tobacco, cannabis and e-cigarettes across the unincorporated county's public places: county property, parks and other recreational areas, streets, sidewalks, restaurants and bars, and within 20 feet of open-air dining or any public building's entrance, exit or air intake.
In addition to all places where smoking is prohibited under California or federal law, smoking shall be prohibited in the following places within the unincorporated areas of the county: (1)County property.(2)All recreational areas, which includes any public or private area open to the general public for recreational purposes whether or not any fee or admission is charged, including without limitation, parks, trails, gardens, tot lots, picnic areas, sporting facilities, stadiums, beaches, piers, and playgrounds and special places as listed in the park and recreation element of the county general plan. ... The county health officer can designate limited smoking areas, and the health officer and parks director can jointly authorize designated smoking spots in county regional parks and golf courses. 040 puts the duty on property owners, managers and operators too: knowingly allowing smoking to continue after asking the smoker to stop and to leave is itself a violation, though staff are not required to physically eject anyone. 050, and any violation can also be treated as a public nuisance under county or state law.
Violations & Fines
Smoking, or knowingly permitting smoking, in any banned location is an infraction under Section 8.22.060, chargeable under Chapter 1.04 fines. That reaches an owner, operator or manager who lets smoking continue in a covered facility as well as the smoker. Enforcement is discretionary and rests with the county administrative office and county staff per Section 8.22.050.
