Summary

Polk County lets the county manager designate specific county-owned or leased parks as no-smoking, no-vaping zones, at which point smoking, vaping, and tobacco use are barred everywhere in that park except the parking areas. The designation, not a blanket countywide law, decides which parks are covered.

City-specific rules exist: Lakeland, and Winter Haven have their own outdoor smoking restrictions rules that differ from Polk County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Prohibition of smoking and vaping in recreational areas. Smoking and the use of all other tobacco products is prohibited in all parks owned by Polk County designated no smoking or vaping by the county manager or their designee. Designation of a park as no smoking or vaping by the county manager or their designee shall be done through a memorandum to the appropriate division. Unfiltered cigars are exempted under F.S. § 386.209. If a park is designated no smoking or vaping by the county manager, parking areas of the park shall be the designated smoking areas for the park.

Full Breakdown

6-1 defines "smoking" broadly to cover inhaling, exhaling, burning, carrying, or possessing any lighted or heated tobacco product, and separately defines "vaping" as using a vapor-generating electronic device such as an e-cigarette, e-cigar, e-pipe, vape pen, or e-hookah, whether or not the substance contains nicotine. 209. Subsection (b) prohibits smoking and tobacco use in any county-owned or leased park that the county manager or their designee has designated no-smoking-or-vaping, done through an internal memorandum to the relevant county division; once a park is designated, its parking areas automatically become the park's smoking area.

Subsection (c) separately bans disposing of tobacco product waste, defined to include cigarette butts, cigar tips, vapor cartridges and packaging, anywhere in a park, and requires the county to post at least one clear "No Smoking or Vaping" sign at each entrance and at gathering spots like restrooms and playgrounds, though the absence of a sign is not a defense to a citation. Subsection (d) gives enforcement responsibility to the county manager or designee: violators are reminded and asked to comply, and individuals who violate the policy may be asked to leave the park, rather than facing a monetary fine spelled out in this section.

Violations & Fines

The section does not set a dollar fine; instead, subsection (d) authorizes the county manager or designee to remind a violator to comply and, if the person continues smoking or vaping in a designated no-smoking area, to ask the individual to leave the park. Because the prohibition applies only to parks the county manager has formally designated by memorandum, a park without that designation is not covered by the smoking ban.

Frequently Asked Questions

Is smoking banned in every Polk County park?
No. Section 10.6-1(b) only bans smoking and vaping in parks the county manager or their designee has specifically designated "no smoking or vaping" through an internal memorandum. A park without that designation is not automatically covered, though once designated, the ban applies throughout the park except in its parking areas, which become the park's smoking area.
Does vaping count the same as smoking under Polk County's park rule?
Yes. Section 10.6-1(a)(6) and (7) define vaping as inhaling or exhaling vapor from, or possessing an actively operating, vapor-generating electronic device such as an e-cigarette, e-cigar, e-pipe, vape pen, or e-hookah, and the ban in subsection (b) covers vaping and tobacco smoking equally in any park the county manager has designated no-smoking-or-vaping.
What happens if someone smokes in a designated no-smoking Polk County park?
Section 10.6-1(d) directs the county manager or designee to first remind the person and ask them to comply. If the person keeps smoking or vaping, they may be asked to leave the park. The section does not list a set dollar fine, unlike other Polk County ordinances that carry misdemeanor penalties.
