Collier County, FL Public Conduct: Outdoor Smoking Restrictions (2026)

Sec. 54-335 lists the activities allowed and prohibited within Collier County's preserve lands, and subsection (q) addresses smoking directly in two parts: smoking is prohibited on trails, full stop, and the County may prohibit smoking more broadly, at its sole discretion, when necessary for fire control purposes, a real risk in a county with extensive dry-season preserve acreage and Everglades-adjacent brush. The same subsection folds in a related litter rule that applies regardless of the fire-control discretion: no person may dispose of burning matches, smoking materials or other flammable material except in a designated receptacle, echoed in subsection (f)'s fire rules.

The ban is narrower than a park-wide smoking prohibition; it targets the trail surface itself and leaves other outdoor Collier County spaces, such as county beaches or roadside parks outside the preserve system, to whatever rules apply there. Because the preserve program covers Conservation Collier tracts and Parks and Recreation preserve sites (Sec. 54-332), the trail smoking ban travels with the land wherever the County designates a preserve, and posted preserve signage typically flags it alongside other conduct rules like leash, hunting and camping restrictions found in the same article (Secs. 54-333 through 54-337).
