Gloucester County, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Section 2(aa) of the Gloucester County Parks Rules & Regulations addresses tobacco and vaping narrowly: it bars using or smoking tobacco or e-cigarette (vaping) products in any indoor structures located in a Park Area, such as restrooms, concession buildings or enclosed pavilions. The same sentence then carves out the opposite result outdoors, stating that tobacco products shall be permitted outdoors, except where specifically prohibited. That leaves room for the Department of Parks & Recreation to post individual playgrounds, ballfields or picnic groves as smoke-free without the county having adopted a blanket outdoor ban.

Because the rule is phrased as an indoor restriction with an outdoor default of permitted, a visitor smoking on an open lawn or picnic area that carries no posted smoke-free sign is not in violation of Section 2(aa). Enforcement of the indoor portion runs through the same general provisions as the rest of Section 2: Parks & Recreation staff administer the Rules and Regulations under Section 3(e), can direct a violator to leave under Section 3(f), and a conviction for violating any provision of the Rules and Regulations can bring a fine or imprisonment, or both, for each offense under Section 3(g).
