Full Breakdown
065 declares county property smoke- and tobacco-free to protect employees and the public: smoking and tobacco use are barred inside any interior space Lane County owns or occupies, on all outdoor property or grounds it owns or occupies (the code names parks, natural areas and parking areas specifically), and inside any vehicle owned by the county or any personal vehicle while it is on county property. The one carve-out in that section is for county roads and county-owned rights-of-way, which are not covered by the ban.
005 reach beyond cigarettes: 'smoking' includes burning or heating any tobacco or plant product for inhalation, including marijuana, and expressly includes electronic smoking devices such as vape pens and e-cigarettes. 597: smoking or tobacco use is prohibited in all county parks and parks facilities, with two narrow exceptions, in designated campsites within developed overnight camping areas (unless the Parks Manager suspends that exception for high fire-hazard conditions), and for a member of a federally recognized Oregon tribe using tobacco as part of traditional religious, medicinal or cultural heritage practice with the Parks Manager's approval.
065 that it will refer employees, volunteers, clients, visitors and vendors to cessation resources such as the Oregon Tobacco Quit Line, and the County Administrator sets the standards for communicating the policy to the public.
Violations & Fines
Smoking or using tobacco in a County Park in violation of LC 6.450.597 is a Class D violation. LC 9.075.065 does not itself list a criminal penalty class; it operates as county property-use policy enforced by county staff and the Department, and violations on non-park county property are handled administratively unless they overlap with a separately classified park or facility offense.
