Summary

Sarasota County bans smoking in every County Park under Code of Ordinances § 90-33(a)(21). The ban covers cigarettes, pipe tobacco, and other lighted tobacco products but not unfiltered cigars, and it does not reach a Designated City Park or School Board Facility inside a municipality that has adopted its own smoking rule.

City-specific rules exist: North Port, and Sarasota have their own outdoor smoking restrictions rules that differ from Sarasota County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

(15)Smoking means inhaling, exhaling, burning, carrying, or possessing any lighted tobacco product, including cigarettes, pipe tobacco, and any other lighted tobacco product, but does not include unfiltered cigars.

(21) Smoking within all County Parks. Where a municipality has their own ordinance governing smoking in their parks, this prohibition shall not include: (1) any Designated City Park within a municipality; or (2) School Board Facility within a municipality.

Full Breakdown

Section 90-32(15) of the Sarasota County Code defines Smoking as inhaling, exhaling, burning, carrying, or possessing any lighted tobacco product, including cigarettes and pipe tobacco, but the definition specifically excludes unfiltered cigars. Section 90-33(a)(21) then lists smoking within all County Parks among the conditions, uses, and activities prohibited on County-owned Public Beach Parks, Public Natural Areas, and Public Recreation Areas, plus any beach or foreshore area named in the article, including Siesta Key Beaches out to the Sarasota city limits. The ban carves out one exception: where a municipality has adopted its own ordinance governing smoking in its parks, the County prohibition does not reach a Designated City Park located within that municipality or a School Board Facility inside it, leaving those local rules to control instead.

The Sarasota County Sheriff, municipal police, and any authorized code enforcement officer may issue a citation for a violation, and the County can also post signs at parks and beaches under § 90-36 giving notice of the prohibition. The article was most recently amended by Ordinance No. 2023-021 on July 11, 2023, and by Ordinance No. 2024-065 on October 22, 2024.

Violations & Fines

Smoking within a County Park in violation of § 90-33(a)(21) carries a civil fine of $74.50 under § 90-38(2), plus any additional costs state or local law imposes. A law enforcement or code enforcement officer issues a citation, which must state the date, the facts of the infraction, and the procedure for paying the fine or contesting it in court within 30 days.

Frequently Asked Questions

Can I smoke a cigar on a Sarasota County beach?
The County's smoking ban excludes unfiltered cigars by definition in § 90-32(15), so an unfiltered cigar is not "Smoking" under this article. Cigarettes, pipe tobacco, and other lighted tobacco products remain banned in every County Park and beach area covered by § 90-33(a)(21).
Does the ban apply inside the City of Sarasota's parks?
No. Section 90-33(a)(21) exempts a Designated City Park or School Board Facility within a municipality that has its own smoking ordinance for its parks, so the City of Sarasota's or Venice's own park rules control there instead of the County ban.
What's the fine for smoking in a County park?
Section 90-38(2) sets a civil fine of $74.50 for violating the § 90-33(a)(21) smoking prohibition, plus any additional court costs or charges state or local law adds, issued through a citation from a law enforcement or code enforcement officer.
