(c)It shall be unlawful for any person to drink any alcoholic beverage, as defined in Article 2B of the Annotated Code of Maryland, and to possess any alcoholic beverage in an open container while:(1)On public property unless authorized by a governmental entity that has jurisdiction over the property;(2)On the mall, adjacent parking area, or other outside area or any combination of privately owned retail establishments, like a shopping center, where the general public is invited for business purposes, unless authorized by the owner of the shopping center...(4)In any vehicle located on any of the places enumerated in this Section, unless authorized pursuant to paragraphs (1), (2), or (3)...(f)Any person who violates the provisions of this Section shall be guilty of a misdemeanor and on conviction is subject to:(1)For the first offense, a fine not exceeding $100;(2)For a second offense, a fine not exceeding $250, a referral to twenty (20) hours of alcohol abuse treatment, or forty (40) hours of community service, or any combination thereof...(4)For a fourth offense or any subsequent offenses, a fine not exceeding $1,000.

Sec. 14-136, adopted under the authority of Sections 19-103 and 19-204 of Article 2B of the Annotated Code of Maryland, bans drinking any alcoholic beverage and possessing one in an open container on public property, on the parking areas of shopping centers open to the public, on the parking area of any other retail establishment, and inside any vehicle parked in those locations, unless the government agency in charge of the property or the property owner has authorized it. "Public property" is defined broadly to include any building, ground, park, street, highway, alley, sidewalk, station, terminal, or parking area owned, leased, or operated by the state, county, a municipality, the Washington Suburban Sanitary Commission, the Maryland-National Capital Park and Planning Commission, or the Washington Metropolitan Area Transit Authority.

The head of the agency controlling the property may permit drinking where the occasion is one where it is customarily allowed and won't offend the public. A carve-out excuses passengers in a vehicle equipped with a toilet, such as a tour bus, if the operator consents. The Police Department is required to keep a log of every citation issued under this Section, including convictions, repeat offenders, and the zip codes where violations occur, and to report that data to the County Council on request.

Violations & Fines

A violation is a misdemeanor with fines that climb by offense: up to $100 for a first offense, up to $250 for a second (plus optional referral to 20 hours of alcohol-abuse treatment or 40 hours of community service), up to $500 for a third (40 hours treatment or 80 hours service), and up to $1,000 for a fourth or later offense (60 hours treatment or 100 hours service). Community service must be completed within one year or the offender faces one hour of jail for each uncompleted hour.
