Boulder County, CO Public Conduct: Public Alcohol Use (2026)

Unlike the flat bans on smoking and marijuana in the same resolution, Rule 16 of Boulder County's Parks & Open Space Rules and Regulations (Resolution No. 2023-024, adopted April 2023, superseding Resolution No. 2023-020) permits alcohol by default: possession and consumption is allowed anywhere on department land so long as the user is also complying with every other rule in the resolution and with state law, which still bars minors from possessing alcohol and prohibits public intoxication and disorderly conduct. The rule carves out a specific exception for vendors at the Boulder County Farmers' Market, who may run tastings at the Fairgrounds without a separate Special Events Permit if they comply with the Fairgrounds Policy Manual and the county's lease with the Farmers' Market.

Critically, the default permission is not absolute: Rule 16's final sentence lets the Board prohibit alcohol at any specific Boulder County Parks & Open Space area by its own action, so a posted sign at a given trailhead or park can override the general allowance. Because Rule 32's fine schedule does not list alcohol among the offenses given a separate rate (parking, weapons, hunting, and fire-related violations), a violation of a Board-posted alcohol restriction defaults to the general 'Regulations assessments' rate of $100. §§ 29-7-101(2) and 30-15-402.
