Mercer County, NJ Public Conduct: Public Alcohol Use (2026)

A. 21, open the 'Alcoholic Beverages' section with a blanket prohibition: no person may possess or consume alcoholic beverages, drugs, or narcotics in any Mercer County Park or Recreation Area, and no one may be present under the influence of intoxicating beverages, drugs, or narcotics. The only carve-out is discretionary: the Commission may designate special use areas or special events where alcohol may be consumed. In practice that carve-out is built out in a second section, 'Alcoholic Beverages Pertaining to Designated Picnic Areas,' which limits consumption in reserved picnic pavilions to moderate amounts of beer and wine during a meal, requires beer in cans or kegs and wine only in boxes, bans glass containers outright, and bars anyone under New Jersey's legal drinking age from possessing or consuming alcohol on the grounds even under a picnic permit.

A picnic permit holder must name one individual as the compliance person responsible for the group's alcohol use and must indemnify the Park Commission against any consequences from that consumption. Outside a permitted picnic area, or without a Commission-designated event, alcohol of any kind is off-limits anywhere in the county park system, from open grove picnic areas to trails, lakes and ballfields. Violations fall under the same Penalties section that governs the rest of the rulebook, and Park Rangers and Sheriff's deputies patrol to enforce the ban.
