Summary

A tenant or anyone else can trigger a county rental inspection just by filing a complaint about code violations, letting inspectors skip straight to the unit without waiting on the owner's own inspection report.

City-specific rules exist: Elk Grove, Sacramento, and Rancho Cordova have their own tenant complaint process rules that differ from Sacramento County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

An inspection by the County may be conducted without reference to the original inspection report if code violations are visible from the exterior of the property or if the County receives a complaint concerning code violations at a property.

E. For purposes of a compliance audit, the owner or manager shall provide all requested inspection reports prepared pursuant to subsections (A) and (B) of this section to the Director. Said inspection reports shall be provided within 72 hours from the date they are requested.

F. The owner or manager shall provide a copy of all inspection reports required by subsections (A) and (B) to the tenant no later than 10 calendar days from the completion of the inspection. (SCC 1407 § 3, 2008; SCC 1601 § 1, 2016; SCC 1707 § 1, 2022; SCC 1749, 1/28/2025)

Full Breakdown

Sacramento County's Housing Code lets the Community Development Department inspect a rental unit without relying on the owner's self-inspection report whenever the county receives a complaint about code violations at the property, or whenever violations are visible from the exterior. A "complaint" is any notification lodged with the Code Enforcement Division alleging a violation of the Housing Code. A resulting notice of violation can also pull an otherwise-exempt rental back under the chapter's regular inspection requirements.

Violations & Fines

A complaint-triggered inspection that turns up violations leads to a notice of violation, repair or vacate orders, and can strip a property of any inspection exemption it previously held.

Frequently Asked Questions

Does a tenant complaint bypass the owner's self-inspection report?
Yes. Section 16.20.410(D) lets the county inspect directly if it receives a complaint about code violations at the property.
Can a complaint affect a unit that's normally exempt from inspection?
Yes. A rental exempt under Section 16.20.420 loses that exemption once a notice of violation is issued on the property.
