Concord follows federal Title X and California Health & Safety Code requirements for lead-based paint disclosure in pre-1978 rental units. Landlords must provide the EPA pamphlet "Protect Your Family From Lead in Your Home," disclose known lead hazards, and include the Lead Warning Statement in leases. Concord does not impose additional local disclosure requirements beyond state and federal law.
Rental properties in Concord built before 1978 are subject to the federal Residential Lead-Based Paint Hazard Reduction Act (Title X, 42 USC §4852d) and California Health & Safety Code §105250 et seq. Before a tenant is obligated under a lease, the landlord must: (1) disclose the presence of any known lead-based paint or lead-based paint hazards; (2) provide any records or reports available concerning lead-based paint in the unit; (3) deliver the EPA-approved pamphlet "Protect Your Family From Lead in Your Home"; and (4) include an attachment to the lease containing a Lead Warning Statement signed by both parties. The Contra Costa County Environmental Health Division and California Department of Public Health Childhood Lead Poisoning Prevention Branch investigate elevated blood-lead complaints. California Civil Code §1941.1 makes lead hazards a habitability issue, and Cal/OSHA §1532.1 governs renovation work. Concord has not adopted a separate municipal lead ordinance; enforcement flows through state and federal channels, with code enforcement addressing deteriorated paint as a housing-code violation under Concord Municipal Code Title 8 (nuisance) when it creates a health hazard.
