Walnut Creek follows the federal Residential Lead-Based Paint Hazard Reduction Act (Title X, 42 U.S.C. §4851) requiring landlords of pre-1978 rental housing to disclose known lead-based paint hazards and provide the EPA pamphlet "Protect Your Family From Lead in Your Home" before lease signing.
Properties built before 1978 are subject to federal lead-based paint disclosure law, enforced in California through the Department of Real Estate and local code enforcement. Walnut Creek does not impose additional municipal lead disclosure requirements beyond federal rules, but landlords must: (1) provide the EPA-approved lead hazard information pamphlet to tenants, (2) disclose any known lead-based paint or lead hazards in the unit or common areas, (3) include a Lead Warning Statement in the lease with both parties' signatures, and (4) retain signed disclosure forms for at least three years. California Civil Code §1940.7 additionally requires disclosure of known environmental hazards. Renovation, repair, or painting work disturbing more than 6 square feet of interior painted surface in pre-1978 units must be performed by an EPA Lead-Safe Certified Renovator under the RRP Rule. Contra Costa Health Services investigates childhood lead exposure cases and may issue abatement orders. Violations of federal disclosure rules carry civil penalties up to $21,916 per violation plus treble damages to affected tenants.
