Pittsburg, CA Rental Property Rules: Lead Paint Disclosure (2026)

Any residential rental unit in Pittsburg built before January 1, 1978 is subject to the federal Residential Lead-Based Paint Hazard Reduction Act (Title X, 42 U.S.C. §4852d) and its implementing regulation, 24 CFR Part 35 / 40 CFR Part 745. Before a tenant becomes obligated under a lease, the landlord must: (1) provide the EPA pamphlet "Protect Your Family From Lead in Your Home," (2) disclose the presence of any known lead-based paint or lead-based paint hazards in the dwelling, (3) provide any available records or reports concerning lead-based paint, and (4) include a signed Lead Warning Statement and disclosure attachment as part of the lease. Both landlord and tenant retain signed copies for at least three years. California Health & Safety Code §17920.10 independently classifies deteriorated lead-based paint and lead-contaminated dust or soil as substandard housing conditions, giving the Pittsburg Code Enforcement Division authority to order abatement. Renovation, repair, and painting that disturbs more than six square feet of interior or twenty square feet of exterior painted surface in pre-1978 housing must be performed by an EPA RRP-certified firm using lead-safe work practices. Childhood blood-lead surveillance is handled by Contra Costa Health Services. Failure to disclose can expose landlords to federal penalties of up to approximately $22,000 per violation plus treble damages in private suits.
