Arizona has no statewide source-of-income protection, and Maricopa County has not enacted local protection. Landlords may legally refuse Section 8 Housing Choice Vouchers, SSI, child support, or other lawful non-wage income as a tenant-screening criterion.
Federal Fair Housing Act protections cover race, color, national origin, religion, sex, familial status, and disability, but not source of income. Arizona Civil Rights Act mirrors federal classes without adding income source. Cities such as Tucson have enacted source-of-income ordinances, but Maricopa County and its incorporated cities (Phoenix, Mesa, Scottsdale, Glendale, Tempe, Chandler) have not. ARS Section 41-1491.14 and HB 2675 (2016) further restrict cities from compelling landlords to participate in the voucher program. Voucher holders therefore must locate landlords willing to accept HUD payment standards and inspections voluntarily.
No county penalty applies for refusing voucher applicants. Discrimination based on protected federal classes (race, disability, family status) is enforced by HUD or Arizona Attorney General Civil Rights Division with damages, civil penalties up to $25,000, and attorney fees.
