Summary

Leon County's own Rural Zoning District rules state that a bona fide farm operation is exempt from local regulation on land classified agricultural, mirroring Florida's Right to Farm Act. Sec. 10-6.612 writes that protection directly into the zoning code's use table for agricultural, silviculture and natural-resource land.

These county ordinances apply to unincorporated areas of Leon County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Pursuant to F.S. § 823.14, a bona fide farm operation shall be exempt from local regulation, ordinance, rule or policy that prohibits, restricts, regulates or otherwise limits activities of a bona fide farm operation on land classified as agricultural land pursuant to F.S. § 193.461. Pursuant to F.S. § 823.14(3)(b), the term "farm operation" means all conditions or activities which occur on a farm in connection with that farm's products.

Full Breakdown

Leon County's Land Development Code does not merely nod at the state Right to Farm Act, it repeats the exemption inside its own Rural Zoning District regulations. Sec. 612 sets out the district's permitted, prohibited and restricted uses on land in the rural future land use category, covering agriculture, silviculture, wholesale farm-product raw materials, wholesale nursery products and related uses, alongside restricted uses such as commercial kennels, veterinary clinics, riding academies and outdoor sport shooting ranges. 14. 14(3)(b). Because the exemption is written into the zoning use table itself, it protects everyday farm activities, noise, odor, dust, spraying and equipment operation, from being treated as a zoning violation or nuisance so long as the land carries an agricultural land use classification and the operation is bona fide, meaning genuinely engaged in production rather than a hobby or pretextual use.

Violations & Fines

There is no local penalty here because the provision is a defense, not a prohibition: a farm operation invoking Sec. 10-6.612's exemption cannot be cited under county zoning, nuisance, or land development enforcement for activities the Right to Farm Act protects. A neighbor or the county must instead show the operation is not bona fide, or that the land lacks an agricultural classification under F.S. § 193.461, before any local rule can apply.

Frequently Asked Questions

Does Leon County have its own right-to-farm protection, or just the state law?
Both point the same direction: Sec. 10-6.612 of the Rural Zoning District regulations writes the state Right to Farm Act's exemption directly into the county's own use table, so the protection appears in local zoning code, not only in Florida Statutes.
What does it take for a farm to qualify for the exemption?
The operation must be a bona fide farm operation, meaning genuinely engaged in producing, harvesting or raising agricultural commodities or livestock, and the land must carry an agricultural land use classification under F.S. § 193.461; a hobby operation or land classified for another use does not qualify.
Can a farm be cited for noise or odor complaints under this exemption?
Not for activities that are part of a qualifying farm operation. Sec. 10-6.612 exempts bona fide farm operations from any local regulation, ordinance, rule or policy that would otherwise prohibit, restrict, or limit those activities on agricultural land.
