Full Breakdown

Article 2A of the Land Use Ordinance puts direct legal duties on hosting platforms, not just individual hosts. 10 makes it unlawful for a platform to provide and collect a fee for booking services connected to any bed and breakfast home or transient vacation unit in the city that is not lawfully registered, permitted, or otherwise allowed, and requires the platform to exercise reasonable care to confirm registration before booking; it also bars platforms from collecting fees for ancillary services like cleaning, concierge, catering, or property management tied to an unregistered unit, and requires listings for hotel or timeshare units to include the property's tax map key number.

20 separately requires any platform providing STR booking services in the city to register with the department, pay a $100 registration fee, and agree in writing to obtain owner consent for disclosures and to report required data. 30 obligates registered platforms to report monthly, in the format the director specifies, the responsible person, address, transient accommodations tax ID, length of stay, and price paid for every city listing booked that month; the director can share that data with state and city officials to enforce tax and land use laws. 150-2(e)(2)(D) and (E) for the underlying STR violation.

Violations & Fines

Section 21-2A.40 states the fine applies notwithstanding the civil fines already specified in § 21-2.150-2(e)(2)(D) and (E), meaning a platform can be fined under both provisions for the same unregistered listing: $1,000 to $10,000 per day under Article 2A for the platform's own booking-services violation, stacked with the separate per-day fines the underlying STR operator faces.

Frequently Asked Questions

Can Airbnb or Vrbo be fined for an illegal Honolulu listing?
Yes. ROH § 21-2A.40 lets the director fine a hosting platform between $1,000 and $10,000 for each day it keeps providing or collecting fees for booking services connected to a bed and breakfast home or transient vacation unit in the city that isn't lawfully registered, on top of whatever fines the property owner separately owes.
Do booking platforms have to register with Honolulu?
Yes. Section 21-2A.20 requires any hosting platform offering STR booking services in the city to register with the Department of Planning and Permitting, pay a $100 fee, and agree in writing to obtain owner consent for data disclosures and to report the required listing information monthly.
What information must platforms report about Honolulu listings?
Section 21-2A.30 requires registered platforms to report, monthly and in the format the director specifies, the name of the person responsible for each listing, its address, the owner's transient accommodations tax ID, the length of each stay, and the price paid, for every bed and breakfast home or transient vacation unit booked through the platform that month.
Is a platform responsible for confirming a listing is legal before booking it?
Yes. Section 21-2A.10 requires a hosting platform to exercise reasonable care to confirm that a bed and breakfast home or transient vacation unit is lawfully registered, permitted, or otherwise allowed before it provides booking services or collects a fee, and separately bars it from collecting fees for cleaning, concierge, or similar services tied to an unregistered unit.
