Short-term rentals in Green Bay must comply with Section 27.203 of the Green Bay Municipal Code, which prohibits unreasonably loud noise and treats any A-weighted sound exceeding 80 dB(A) measured from neighboring property as presumptively unreasonable. Daytime hours run 7:00 a.m. to 10:00 p.m. and nighttime hours run 10:00 p.m. to 7:00 a.m. Section 44-1580(j)(12) makes a tenant noise disturbance an STR permit violation enforceable against the host.
Green Bay's noise rule is set out in Section 27.203 of Chapter 27 (Public Peace and Good Order), Subchapter II - Noise. Section 27.203(2) prohibits any person from producing unreasonably loud noise and lists four factors a court may weigh: decibel level, time of day, land use, and duration. Section 27.203(2)(a) provides that a court may determine any noise unreasonable solely because it exceeds 80 dB(A) measured with an A-weighted sound pressure level instrument from any property not under the control of the person producing the noise. Section 27.203(1)(b) defines daytime hours as 7:00 a.m. to 10:00 p.m. and Section 27.203(1)(d) defines nighttime hours as 10:00 p.m. to 7:00 a.m. Certain activities are presumed reasonable under Section 27.203(4): construction work during daytime hours Monday through Saturday, lawn mowers and power equipment during daytime hours, residential air conditioning, and waste collection during nighttime hours Monday through Friday. Loudspeakers on streets are governed separately by Section 27.202, which bars loudspeaker permits before 9:00 a.m. or after 9:00 p.m. STR-specific obligations are set out in Section 44-1580(j) of the zoning code: subsection (j)(1)(c) requires every STR lease to include language requiring the guest to comply with Green Bay noise and parking ordinances; subsection (j)(12) makes any disturbance or nuisance caused by STR tenants - including outdoor events and noise ordinance violations - a permit violation. A host wishing to host a louder event must apply at least 30 days in advance to the Green Bay Police Department for a special permit under Section 27.203(5). Wisconsin Statute 66.1014 prevents Green Bay from banning rentals of seven days or longer but expressly preserves municipal noise enforcement.
Section 27.203(6) sets a forfeiture of not more than $200 for each unreasonable-noise violation, enforced by the Green Bay Police Department. Section 44-1580(j)(12) separately authorizes a forfeiture up to $500 per STR violation including court costs and may result in suspension or revocation of the Short-Term Rental Permit (STRP). Section 44-1580(j)(9) also authorizes the Community and Economic Development Director or Plan Commission to review a STRP at any time for non-compliance.
