The Village of Little Chute has not adopted a dedicated short-term rental licensing chapter in its published Code of Ordinances. Short-term rentals operating in Little Chute are therefore governed by the Wisconsin 'right to rent' statute, Wis. Stat. Sec. 66.1014, together with the Village's general public-nuisance provisions in Chapter 28 of the Code of Ordinances and the offenses provisions in Chapter 30. Wis. Stat. Sec. 66.1014(2)(a) preempts local prohibition of residential rentals of 7 consecutive days or longer but expressly preserves municipal authority to enforce noise, nuisance and other local regulations against rental operators and their guests. Tourist rooming houses are also licensed at the state level by the Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) under Wis. Admin. Code ATCP 72.
Wis. Stat. Sec. 66.1014(2)(a) provides that 'no political subdivision may enact or enforce an ordinance that prohibits the rental of a residential dwelling for 7 consecutive days or longer.' The same statute at Sec. 66.1014(2)(d) authorizes a political subdivision to limit total rentals of less than 7 consecutive days to 180 days per year and to require a license. The Village of Little Chute has authority under Wis. Stat. Sec. 61.35 (village zoning) and Sec. 66.0413 (general nuisance authority) to enforce noise and nuisance ordinances against short-term rental guests just as against other residential occupants. The Village's published Code of Ordinances on Municode includes Chapter 28 Nuisances and Chapter 30 Offenses, which contain the general prohibitions on disturbing conduct that apply throughout the Village. Wisconsin DATCP issues the state Tourist Rooming House license that any STR rented for fewer than 30 consecutive days must hold under Wis. Stat. Sec. 97.605 and Wis. Admin. Code ATCP 72. The Tourist Rooming House license requires an annual inspection covering health, safety, and noise-impact considerations. Outagamie County is the issuing health authority for DATCP-agent inspections in this region. Because Little Chute has not enacted a dedicated STR ordinance like neighboring Appleton or Ashwaubenon, hosts must rely on general Village conduct rules, the state Tourist Rooming House inspection regime, and Wisconsin's right-to-rent framework.
