Perris addresses short-term rental noise in two places. First, Section 5.38.080 of the short-term rental chapter requires the owner to ensure that guests and daytime occupants do not violate the provisions of the Municipal Code pertaining to noise, disorderly conduct, and drug and alcohol laws, and to take action to prevent a recurrence of the conduct within 24 hours of being notified of a violation. The owner must also provide a 24-hour emergency contact, located within a 25-mile radius of the rental, to respond to complaints. The rental is restricted to overnight lodging only and may not be used for weddings, parties, bachelor or bachelorette parties, conferences, or similar events, which targets the most common source of short-term rental noise complaints. Second, the underlying noise standards come from the city's Noise Control chapter, Chapter 7.34 of the Perris Municipal Code. Section 7.34.040 sets sound-amplification limits in residential settings of 60 dBA between 10:01 p.m. and 7:00 a.m. and 80 dBA between 7:01 a.m. and 10:00 p.m. Section 7.34.050 lists factors for determining a violation, including the noise level, the time of day, the duration, and whether the noise exceeds the ambient level by more than 1.0 decibel. Guests of a Perris short-term rental are bound by these citywide noise limits just like any other resident.
Failing to ensure guest compliance with the noise rules, or failing to correct a reported problem within 24 hours, violates Section 5.38.080 and is enforceable under Section 5.38.100. A noise violation can also be cited directly under Chapter 7.34. Repeated noise problems are grounds for suspending or revoking the short-term rental business license under Section 5.38.090. Each day a violation continues is a separate offense.
