Short-term rentals in West Allis must follow Section 7.035 of the West Allis Revised Municipal Code. Wisconsin Statute 66.1014 (the 'right to rent' law) prevents West Allis from banning short-term residential rentals of seven consecutive days or longer, but expressly preserves municipal authority to enforce noise, health and safety rules against tourist rooming house operators and their guests. West Allis Revised Municipal Code Section 7.035 was repealed and recreated by Ordinance O-2013-0036 to address excessive noise and vibration, and applies to short-term rentals exactly as it applies to owner-occupied homes. Under the ordinance, 'night' runs from 10:00 p.m. to 6:59 a.m. and 'day' runs from 7:00 a.m. to 9:59 p.m. Sound reproduction devices (stereos, TVs, Bluetooth speakers) may not be plainly audible across a real property boundary at night, and during the day may not be plainly audible from 150 feet beyond the property line. In a multifamily dwelling, no noise disturbance is allowed at night that is plainly audible in another occupied unit. Light motor vehicles may not exceed 80 dBA anywhere in the city, and places of public entertainment may not exceed 100 dBA. The West Allis Health Department is the primary enforcement agency, with the West Allis Police Department also empowered to enforce. Vibration is capped at 70 VdBA at or across the property boundary.
Violators face a forfeiture of not less than $100.00 nor more than $500.00 per offense, plus costs of prosecution under Section 7.035 of the West Allis Revised Municipal Code. Repeat noise complaints tied to a tourist rooming house can be reviewed by the West Allis Health Department at annual license renewal and can result in license suspension or non-renewal. The Health Department or Police Department may also pursue abatement of an ongoing nuisance.
