For the lowest-density residential zones, additional limits apply: 'Short term rentals shall be allowed in the R-1 and R-1A Districts in accordance with these additional regulations: 1. Occupancy of a rentable unit shall be limited to one Family, as defined.' The maximum occupancy and the number of off-street parking spaces are recorded on the Short Term Rental Application, and 'Overnight occupancy of recreational vehicles, camper trailers and tents is prohibited.' Each rental must post a notice at the front door stating 'The maximum number of occupants permitted to stay in the short-term rental at one time' and provide directions on parking and waste disposal; failure to follow the occupancy and parking requirements 'will result in citations of fines.'
Exceeding the occupancy permitted for the zoning district, or in R-1/R-1A exceeding one Family per rentable unit, violates the City of Erie Zoning Ordinance and the STR regulations. The required occupant notice warns that 'failure to follow the occupancy and parking requirements will result in citations of fines,' and occupants may be cited and fined directly for violations.
