Additionally, a maximum of four (4) persons under the age of thirteen (13) shall also be authorized to stay overnight, not to be counted against the maximum occupancy.

LDC Sec. 30.1375(a)(1) sets the maximum overnight transient occupants at two persons per sleeping room. A sleeping room is a fully enclosed room designed for sleeping, accessed by a lockable door and not used as a living room, kitchen, or bathroom (Sec. 30.1373(c)). Up to four persons under age 13 may also stay overnight without counting against the cap. Non-overnight visiting guests are limited to no more than twice the maximum overnight occupancy. The maximum occupancy must be stated on the registration certificate and disclosed in advertising and in the 'Transient Occupant Information' binder kept in the unit.
