Occupancy is capped at eight individuals, or the occupancy limit of the approved on-site wastewater (septic) system, whichever is fewer. That number is the maximum people allowed on the premises at any one time while rented.
Section 6.A.1 sets a hard occupancy ceiling for all licensed short-term and vacation rentals in unincorporated Boulder County: a maximum of eight individuals, or the capacity of the permitted on-site wastewater treatment system if that is lower. The permitted occupancy is the total number of people allowed on the licensed premises at any one time during a rental. Because much of the unincorporated county relies on septic systems, the septic capacity frequently drives the effective limit below eight. The approved occupancy must be stated in every advertisement or listing.
Exceeding the approved occupancy is an ordinance violation. Minor offenses draw $150/$500/$1,000 fines; conduct endangering health, safety, or welfare is a major offense at $750 then $1,000 plus suspension.
