Riverside County Ordinance No. 927, Section 8(h), limits short-term rental occupancy to 200 square feet per person, up to a maximum tied to the size of the property. For properties of one-half acre or less, the maximum is 10 persons. For properties over one-half acre and up to two gross acres, the maximum is 16 persons. For properties over two gross acres, the maximum is 20 persons. The County determines the maximum occupant number for each rental as part of the certificate process. Rentals exceeding 10 occupants must comply with a pre-approved list of building upgrades from the County Building Official. If a lot has multiple single-family dwellings, only one certificate is issued for the lot, the dwellings must be rented together as one STR, and the extra dwellings do not increase the maximum occupancy. In Temecula Valley Wine Country, occupancy is further constrained by classification: a Class I STR allows a maximum of 10 occupants and a Class II STR allows more than 10 and up to 20 occupants. The Equestrian and Residential districts of Wine Country allow only Class I (10), while the Winery District allows Class II (20) with added requirements such as at least 50% of net acreage planted in vineyard or crops. Guests must meet age minimums-21 countywide, 25 in Wine Country.
Exceeding the maximum occupancy approved on the certificate is an enumerated violation under Section 14, attributable to both Responsible Guests and Responsible Operators. Penalties escalate from $1,500 to $3,000 to $5,000, and repeated Verified Notices of Violation can permanently revoke the certificate.
