A Baltimore County short-term rental must provide a minimum of one parking space for every two guests. The application must disclose the number and location of all guest parking spaces, and a host may not advertise more parking than is actually available as determined by the Director.
Baltimore County Code 35-6-208(D) requires a short-term rental to provide a minimum of one parking space per two guests, so parking directly constrains allowable occupancy. On the application (35-6-204), the host must state the number and location of all parking spaces intended for guests, including whether each is on- or off-street, paved or unpaved, and located in a registered parking area. The Director has sole discretion under 35-6-206 to determine the number and location of parking spaces available to guests. Under 35-6-209(A)(3), a host may not advertise on a hosting platform that the rental has more parking than the number of spaces available as determined by the Director.
Advertising more parking than available, or operating with inadequate parking for the guest count, violates the subtitle and can lead to license suspension or revocation plus cumulative civil penalties.
