Vacation house rentals in unincorporated Solano County require a Land Use Permit under Zoning Code Section 28.75.30, plus a Transient Occupancy Tax registration certificate and a county business license before any guest may be hosted.
Per Solano County Code Section 28.75.30(A)(14), 'A vacation rental house shall be permitted only in compliance with the requirements and standards of this section and all other requirements of the applicable zoning district, subject to the issuance of a land use permit. The permit shall be subject to periodic renewal every five years and shall expire upon sale or transfer of the property. Reuse of the dwelling as a vacation house rental by a new property owner shall require approval of a new land use permit.' Section 28.75.30(A)(8) also requires that the operator hold a TOT certificate under Chapter 11 Article II and a business license under Chapter 14, and that both 'be posted in a conspicuous place on the premises prior to operation of the business.' The TOT certificate number and business license number must be listed in 'all contracts or rental agreements, and in any advertising or websites.' Hosted (owner-occupied) rentals are governed separately under Section 28.72.40(B)(5) and are limited to one guest room or sleeping area and one guest vehicle. Vacation house rentals are prohibited in Very High Fire Hazard Severity Zones (Sec. 28.75.30(A)(7)(a)), and ADUs, JADUs, employee housing, and timeshares may not be used as vacation rentals.
Operating without a land use permit, TOT certificate, or business license is a violation of the county's short-term rental ordinance and is subject to administrative penalties under Solano County Code Chapter 10. Section 28.75.30(A)(15) expressly designates Section 28.75.30 as part of the county's short-term rental ordinance for enforcement purposes.
