These county ordinances apply to unincorporated areas of San Benito County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Within 30 days after the effective date of this article, or within 30 days after commencing business, whichever shall first occur, each operator of any hotel renting an occupancy to transients shall register the hotel with the Tax Administrator and obtain from him or her a transient occupancy registration certificate, which shall at all times be posted in a conspicuous place on the premises. The certificate, among other things, shall set forth the following information:

(A)   The name of the operator;

(B)   The address of the hotel;

(C)   The date upon which the certificate was issued; and

(D)   A statement as follows: “This transient occupancy registration certificate signifies that the person named on the face hereof has fulfilled the requirements of the uniform transient occupancy tax law by registering with the Tax Administrator for the purpose of collecting from transients the transient occupancy tax and remitting the tax to the Tax Administrator. This certificate shall not authorize any person to conduct any lawful business or to conduct any lawful business in an unlawful manner, nor to operate a hotel without strictly complying with all local applicable laws, including, but not limited to, those requiring a permit from any board, commission, department or office of the County of San Benito. This certificate shall not constitute a permit.” (1966 Code, § 17A-6) (Ord. 499, § 6)

Full Breakdown

Under the Uniform Transient Occupancy Tax Law, each operator of a 'hotel' renting to transients, a definition reaching short-term rented dwellings, must register with the Tax Administrator within 30 days after commencing business and obtain a transient occupancy registration certificate. The certificate must show the operator's name, the property address, and the issue date, and must be posted at all times in a conspicuous place on the premises.

Violations & Fines

The certificate is not itself a business license; § 5.03.055 states it does not authorize operation without complying with other required county permits, and unpaid tax tied to registration draws the § 5.03.057 penalties (10% plus interest).

Frequently Asked Questions

Does the registration certificate let me operate a short-term rental?
No. § 5.03.055 states the certificate 'shall not constitute a permit' and does not excuse compliance with any other required county permit.
Where must the certificate be displayed?
At all times in a conspicuous place on the rental property, per § 5.03.055.
