Under CB-11-2018 (Subtitle 5, Division 8), an applicant must attest that the short-term rental is the permanent residence of the host, and must provide proof of ownership plus a copy of the host's homestead property tax credit for the location. A permanent resident is defined as someone domiciled in the county who keeps a place of abode there 180 or more days per year, owns the property, and obtains the homestead credit at that address; a host may have only one permanent address. This effectively bars investor-owned second homes from being licensed. Within the primary residence, the host may rent up to 90 days per year when absent, or 180 days when present (owner-occupied).
Renting a property that is not the host's permanent residence, or misrepresenting primary-residence or homestead-credit status, is grounds for immediate denial or revocation of the DPIE short-term rental license.
