Non-commercial short-term rentals must be operator-occupied. Only a natural person may hold one, no more than one per person, and the operator must live on the same lot as the rental. Whole-home, non-owner-occupied STRs are banned in residential districts.
New Orleans limits residential STRs to owner/operator-occupied properties. Only natural persons 18 or older may own a non-commercial (Type N) STR, and no person may hold more than one owner permit or own more than one non-commercial STR. The Comprehensive Zoning Ordinance requires the operator, historically shown by a homestead exemption, to reside on the same lot as the unit; the 2023 rewrite replaced the homestead test with a requirement that the operator live on the same lot. In a single-family home, one bedroom must be reserved for the operator's full-time occupancy, so whole-house rentals with no on-site operator are not allowed in residential areas.
Advertising or renting the operator's reserved bedroom as a guest bedroom, or operating without the required on-site operator, is a prohibited act subject to at least a $1,000 fine and revocation.
