Application is filed with the Department of Development Services (Business Tax Receipt office) and requires: a completed Short-Term Rental application; proof of ownership; an owner-designated 24-hour local responsible party who can respond to complaints; a sworn affidavit of compliance with the Β§153.26 minimum standards; a current DBPR Division of Hotels and Restaurants vacation rental license under F.S. 509.241; a Florida Department of Revenue Certificate of Registration for sales tax; a Broward County Business Tax Receipt and Tourist Development Tax account; and payment of city application and inspection fees. Inspections are coordinated by Code Compliance, Building, Fire-Rescue, and Landscape divisions and confirm compliance with the city code, the Florida Building Code (HVHZ), and the Florida Fire Prevention Code. Florida Statute 509.032(7)(b) preempts adoption of new STR-specific zoning rules after June 1, 2011, but expressly preserves city authority to license, inspect, and enforce uniformly applicable life-safety, building, and registration requirements such as this permit program.
Operating without a permit, failing to renew, or advertising a non-permitted unit is a Chapter 153 violation enforceable by the Special Magistrate under F.S. Ch. 162 with daily fines up to $250/day (first violation) and $500/day (repeat), plus permit denial or revocation. DBPR may separately fine unlicensed operators under F.S. Ch. 509.
