Pompano Beach does not cap the number of nights a property may be rented short-term. Florida Statute 509.032(7)(b) preempts cities from regulating the duration or frequency of vacation rentals through any ordinance enacted on or after June 1, 2011, and Pompano Beach's STR ordinance (Ord. 2017-50, codified at Chapter 153) is post-2011 and not grandfathered. There is no annual rental-night cap, no minimum-stay requirement, and no per-stay cap — but registration, occupancy, and tax rules still apply.
Florida Statute 509.032(7)(b) prohibits a local government from passing any law, ordinance, or regulation that prohibits vacation rentals, regulates the duration or frequency of vacation rentals, or is more restrictive than the state Public Lodging chapter, unless the local rule was on the books before June 1, 2011. Pompano Beach's vacation-rental program was enacted by Ordinance 2017-50 and codified in Chapter 153 (Rental Housing Code), so it sits squarely within the preemption window — meaning the city cannot lawfully cap nights per year, impose minimum-stay requirements, or limit how often a property turns over. Stays of 184 days or less are 'transient' and subject to the city's STR registration program and to all transient lodging taxes; stays of more than 184 consecutive days fall outside the STR/DBPR framework entirely. The city does limit one special event per fiscal year per permitted property, regulates noise around the clock, and caps occupancy at 2 persons per bedroom under §153.26, but those are uniformly applicable safety/conduct rules, not a night cap. Hosts who book through Airbnb or Vrbo should note that platform algorithms may suggest minimum-stay 'rules' to comply with HOA or condo association policies — those are private restrictions, not a city night cap.
Because there is no city night cap, no penalty attaches to high turnover or short stays as such. However, exceeding §153.26 occupancy, holding more than one special event per fiscal year, violating noise rules, or operating without an annual permit triggers Chapter 153 enforcement by the Special Magistrate with fines up to $250/day (first) and $500/day (repeat) under F.S. Ch. 162.
