York County levies a 5% hotel room excise tax that applies to short-term rentals of under 30 days, on top of Pennsylvania's 6% state hotel occupancy tax. Airbnb and other booking agents collect and remit both.
This is the genuine county-level rule for short-term rentals. York County's Hotel Room Excise Tax (Ordinance 2019-02, administered by the County Treasurer) imposes a 5% tax on room rentals to fund county-wide tourism promotion. It stacks on Pennsylvania's statewide 6% hotel occupancy tax. Pennsylvania's Act 109 of 2018 expanded the definition of 'operator' to include booking agents, so platforms like Airbnb and Vrbo now collect and remit both the state and county tax directly. A host who does not exclusively use a tax-collecting booking agent must register with the PA Department of Revenue and remit the tax themselves via myPATH.
Unremitted hotel tax is subject to Department of Revenue and County Treasurer assessment, penalties, and interest. Hosts remain liable if their booking agent fails to collect the tax.
