Hidalgo County does not impose a county-level hotel occupancy tax or STR registration fee in unincorporated areas. Operators must collect the 6% Texas state hotel occupancy tax (Tax Code Ch. 156). Cities like McAllen, Edinburg, Pharr, Mission, and Weslaco add their own 7% municipal HOT inside city limits.
Texas counties may only impose a hotel occupancy tax (HOT) if specifically authorized by the Legislature in Tax Code Chapter 352. There is no published Hidalgo County HOT for unincorporated short-term rentals; the county does not list an STR or hotel tax on its tax-collector or treasurer pages. Statewide, every short-term rental of 30 days or fewer is subject to the 6% state HOT under Tax Code Ch. 156, collected and remitted directly to the Texas Comptroller via a hotel tax permit. Airbnb and Vrbo collect the state 6% on behalf of hosts in Texas. Inside incorporated cities (McAllen, Edinburg, Pharr, Mission, Weslaco, Mercedes, Donna, Alamo, San Juan, Hidalgo, La Joya), the city's municipal HOT (typically 7% under Tax Code Ch. 351) applies on top of the state tax and is paid directly to that city. Confirm any county-level fees with the Hidalgo County Tax Office at 956-318-2157.
Failure to collect or remit the 6% state HOT can result in interest, a 5%-10% late-filing penalty, and loss of the hotel tax permit under Tax Code Β§156.201. Municipal HOT non-payment inside city limits is enforced by that city, with penalties set by city ordinance.
