Summary

The Director may immediately remove from any county highway any encroachment which: (1)Is not removed or the removal of which is not commenced and thereafter diligently prosecuted within five (5) days after the service of the notice.(2)Obstructs or prevents the use of the highway by the public.(3)Consists of refuse.(4)Is an advertising sign of any description unless the advertisement is a notice posted as required by law.

Sections 10-3106 and 10-3107 let the Director of Public Works order removal of any encroachment in, under, or over a county highway, road, or land. The owner or occupant gets written notice, by personal service, mail, or five days' posting, demanding immediate removal. If the encroachment isn't removed within five days, obstructs public use of the highway, consists of refuse, or is an unlawful advertising sign, the Director can remove it immediately without further wait. Section 10-3108 lets the County recover removal costs plus ten dollars for each day the encroachment remains past the deadline.
